Borrower suing debt collector claiming harassment

CHARLESTON — A consumer is suing a debt collector, citing alleged unlawful debt-collection practices.

Kathy Bailey filed a complaint in Kanawha Circuit Court against Atlantic Credit and Finance Inc. alleging that the debt collector violated the West Virginia Consumer Credit and Protection Act.

According to the complaint, Bailey alleges that she suffered harassment, embarrassment, oppression, abuse, aggravation, annoyance and inconvenience. She holds Atlantic Credit and Finance Inc. responsible because it allegedly unlawfully called and sent letters to her family members not involved in her alleged debt and disclosed the same for the purpose of harassing her and coercing payments.

The plaintiff requests a trial by jury and seeks compensatory, statutory and punitive damages, interest, costs, attorney's fees and all other relief deemed equitable and just. She is represented by Michael Cary of Cary Law Office PLLC in Charleston.
