Select Energy Services is accused of not accommodating employee with special needs

CLARKSBURG — A couple claims a company discriminated against an employee due to his disability.

Richard W. and Tracie L. Volek filed a complaint in U.S. District Court for the Northern District of West Virginia against Select Energy Services LLC, Rockwater Energy Solutions LLC and Ted Anderson.

According to the complaint, the plaintiff was discriminated against and removed from his company's work schedule after being diagnosed with diabetes and requesting special accommodations.

The defendant is accused of violation of the Americans with Disabilites Act and disability discrimination.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by John McCreary Jr. of Babst, Calland, Clements and Zomnir in Pittsburgh.

The case has been removed to federal court, where it was assigned to Judge Gina Marie Groh.
