Notice of $6 million award from California court in case over operation of Super98 filed in Ohio County

WHEELING – A notice of a $6 million award in a breach of fiduciary duty lawsuit has been filed in a West Virginia court from a case that originated in California.

An order filed on May 22, 2018, in Orange County, California Superior Court stipulated that Cardinal Collection Educational Foundation, Martin Logies and John Skirtich were entitled to recover $6 million plus interest on a claim against Super98 LLC, Robert D. Hesselgesser M.D., James Hesselgesser and Walter Knauss.

The order states that in June 2016, the plaintiffs/petitioners served the defendants/respondents with a demand for arbitration over an alleged breach of fiduciary duty by the defendants in their operation of Super98 LLC. The order states the petition to confirm the arbitration award was granted in a hearing in April 2018.

The plaintiffs are represented by John A. Kaniewski, Anna Greenstin and Marissa Flores of WFBM LLP in Orange, California.

A notice of filing foreign judgment was filed in Ohio Circuit Court.
