BORDAS & BORDAS PLLC: Monsanto Settles RoundUp Labeling Lawsuit- Thousands of Personal Injury Cases Remain

Bordas & Bordas PLLC issued the following announcement on Aug. 28.

The US Court of Appeals for the Eighth Circuit recently approved a $21.5 million settlement of a lawsuit between Monsanto Co. and consumers over Monsanto’s misleading labels on concentrated versions of Roundup weed killer Chief Judge Lavenski R. Under the settlement, more than 70,000 consumers who made valid claims will receive full reimbursement for the products they bought.

The nature of this particular lawsuit centered on Monsanto’s “aggressive marketing” of Roundup as being safe for humans and animals, despite newer studies indicating that glyphosate may cause cancer and adversely affect human and animal cardiovascular, endocrine, nervous and reproductive systems. Specifically, this lawsuit charged that Monsanto’s packaging statement that Roundup’s active ingredient, glyphosate, targeted “an enzyme found in plants but not in people or pets” was false, deceptive and misleading because the enzyme that glyphosate supposedly targets is, in fact, found in people and domestic animals.

The claims in this recently settled case are different than those of the 13,400 cancer victims who have brought personal injury claims before various Courts throughout the country alleging that Roundup is unsafe and causes cancer. Those cases continue to work their way through the courts with no settlement expected anytime soon. But Monsanto’s settlement of its labeling exposure is hopefully a first step on the road to compensating those who contracted cancer from their use of Roundup.
