Prime Insulation, Inc. and Prime Inc. v. Randall L. Barrett

* Prime Insulation filed a suit against Randall Barrett, claiming Barrett violated the West Virginia Computer Crime and Abuse Act. Barrett was fired for sexually harassing his co-worker and insubordination. According to the suit, Barrett's job duties included working with documents that contained "sensitive information and trade secrets." The documents were stored on an "S" drive on his workplace computer. According to the suit, Barrett asked a third party to copy the files from his computer onto a CD. Prime claims Barrett's actions put the secrets of the company in danger. Prime claims Barrett also violated the Uniform Trade Secrets Act. They claim he obtained private information through theft and misrepresentation. They seek compensatory and punitive damages.

Patricia M. Thompson v. City of Charleston and John Doe Property Owner
PA – J.C. Powell; J – Stucky
* Patricia Thompson filed a suit against the City of Charleston after she fell on a hole in a sidewalk and fell, hitting her face on a metal lamppost. Thompson claims she fell in a hole created by missing bricks. She sustained extensive injuries and was treated at a local emergency room. Thompson seeks compensatory and punitive damages.

Delmer Matheny and Janet Matheny, Michael Matheny, Joshua Shaw, Kristal Burgess v. West Virginia Department of Health and Human Resources, Deloris Longfellow, Jaime Myers, John Doe, Action Youth Care, Inc., Jane Doe
PA – James P. McHugh, Roger D. Williams; J – Bloom
* Delmer and Janet Matheny filed a suit against the DHHR, after the agency closed the foster home their foster home, based on allegedly unsubstantial claims. The Mathenys claims three of their foster children suffered greatly form the dissolution of their family. In the seven-count suit, the Mathenys claim the DHHR was negligent for refusing to properly investigate the claims. They seeks compensatory and punitive damages.

Joe W. Dempsey, Jr. and Reva Dempsey v. Arvind Viradia, M.D., Kiran A. Majmundar, M.D.
PA – Mark R. Staun; J – Berger
* Joe Dempsey, and his wife Reva Dempsey, filed a medical malpractice suit against Arvind Viradia and Kiran A. Majmundar. According to the suit, Dempsey went to Viradia complaining of diarrhea and weight loss. He was referred for a colonoscopy with Majmundar. According to the suit, Dempsey eventually had to be admitted to The Cleveland Clinic. While there, he had a colectomy, and now has an ileostomy to collect intestinal waste. Dempsey claims the doctors were negligent in their care towards him and caused he and his wife great pain and expense. They seek judgment.
