Charleston woman names physician, practice in medical negligence case

CHARLESTON -- A woman is suing a Charleston physician and West Virginia Gynecologic Oncology Associates after she claims they deviated from the standard of care.

On Nov. 26, 2007, Joyce A. Johnson, of Charleston, claims she suffered complications following the defendants' failure to properly recognize and remedy her condition, according to a complaint filed Jan. 20 in Kanawha Circuit Court.

Johnson claims Dr. Michael A. Schiano and West Virginia Gynecologic Oncology Associates "acted in willful, wanton and reckless disregard for her well being and health."

The defendants deviated from the standard of care by failing to verify and/or document the dosage administered using correct formulas and references; failing to follow and/or document guidelines regarding the assessment and documentation of care; failing to review and/or document the side effects and potential complications; and failing to verify and document the correct, proper placement of the central venous access device prior to the start of therapy.

Johnson is seeking compensatory and punitive damages for physical and mental pain and suffering and medical expenses. She is being represented by Marvin W. Masters and Charles M. Love IV.

The case has been assigned to Circuit Judge Jennifer Bailey.
