Huntington surgeon sued again for medical malpractice

HUNTINGTON -- A Huntington surgeon is being sued again for medical malpractice.

C.R. Bard and Covidien also were named as defendants in the suit.

Dr. Mitchell E. Nutt, an obstetrician and gynecologist in Huntington, performed surgery on Diana Boerke at St. Mary's Medical Center, according to a complaint filed June 24 in Cabell Circuit Court.

During the surgery, Nutt implanted a Ugytex polypropylene mesh, a component of the Avaulta Anterior and Posterior BioSynthetic Support Systems to treat Boerke's pelvic organ prolapse.

According to the suit, Nutt implanting the products into her body was "harmful and unwanted."

Boerke claims since the surgery she has experienced significant mental and physical pain and suffering; has sustained permanent injury; permanent and substantial physical deformity; and loss of a bodily organ system.

Boerke and her husband, John Boerke, are suing for compensatory and punitive damages. Paul T. Farrell Jr., J. Robert Rogers and Gary B. Blasingame are representing the couple.

The case has been assigned to Circuit Judge F. Jane Hustead.
