Charleston woman attacks dog owner with suit over pit bull attack

CHARLESTON -- A Charleston woman is suing NAJ, LLC, and the owner of two pit bulls that attacked her while she was walking along a sidewalk.

NAJ LLC owns a home on Beech Avenue that was rented by Teresa Diamond, who owns two pit bulls, according to a complaint filed Aug. 10 in Kanawha Circuit Court.

On Aug. 24, 2009, Helen R. Jones was traveling past the defendants' home when the two pit bulls were not secured in their pen, nor were they on leashes.

Jones claims the dogs attacked her and bit her several times, causing her injuries.

The two dogs, without any provocation, attacked Jones, and when the police arrived, the dogs then attacked them, causing the police to be forced to shoot the dogs, according to the suit.

Jones claims her injuries required medical treatment and sustain serious and permanent injuries.

The defendants had a duty to act in a reasonable and prudent manner to control and keep the pit bulls in a safe, reasonable and proper manner and to exercise ordinary care necessary to prevent injury, according to the suit.

Jones claims the defendants breached that duty by failing to keep the pit bulls on leashes or in their pen.

Jones is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Robert D. Cline Jr., Robert A. Campbell and Francis M. Curnutte III.

The case has been assigned to Circuit Judge Louis H. Bloom.
