Marshall University sued over surgery

HUNTINGTON – A woman is suing the Marshall University Board of Governors and a surgeon she claims deviated from the acceptable standard of care during her surgery.

On Feb. 10, 2012, Phyllis J. Ross underwent a surgical procedure by Dr. Michael A. Krasnow, according to a complaint filed Feb. 15 in Cabell Circuit Court.

Ross claims during the procedure, Krasnow deviated from the appropriate and acceptable standards of medical care.

The procedure was intended to be blepharoplasties of Ross’ left and right eyes, for the purpose of the excision and removal of excess skin from her eyelids to improve her vision, according to the suit.

Ross claims she consented to the performance of the blepharoplasty procedures only, but, during the procedure, Krasnow made an incision in her forehead that had nothing to do with the proper performance of the blepharoplasty, but was the type of incision which would be utilized for performance of an eyebrow lift.

Krasnow also failed to remove the surgical glue employed to close the incision in Ross’ forehead prior to attempting to remove the sutures from the incision, according to the suit.

Ross claims the defendants violated West Virginia code by deviating from the appropriate standard of medical care and were negligent.

The defendants’ actions caused Ross to suffer extreme pain and suffering, both physical and mental; emotional distress; and permanent scarring of her forehead, according to the suit.

Ross is seeking compensatory and punitive damages with pre-judgment interest. She is being represented by William A. Davis.

The case has been assigned to Circuit Judge David M. Pancake.
