HUNTINGTON - A woman is suing Asphalt Contractors & Site Work Inc. after she sustained injuries in a car accident allegedly caused by one of its employees.
Ernest A. Williams was also named as a defendant in the suit.
On April 29, Williams was maneuvering his vehicle on the lot of Fifth Third Bank on 16th Street in Huntington and occasionally was backing out onto 16th Street when he rammed into the rear right side of Luz Maria Esquivel's 2004 Dodge Durango, according to a complaint filed Nov. 8 in Cabell Circuit Court.
Esquivel claims Williams was acting within the scope of his employment with Asphalt when he negligently and improperly backed into oncoming traffic and struck her vehicle.
Williams failed to keep a proper lookout and failed to give full time and attention to the operation of his vehicle, according to the suit.
Esquivel claims Williams also failed to yield the right of way and failed to obey traffic laws.
The defendants' actions caused Esquivel to suffer injuries to her head, left shoulder, left arm, left hand, neck, back, ribs, legs, left hip and other parts of her body, according to the suit.
Esquivel is seeking compensatory damages. She is being represented by Dwight J. Staples and Gail Henderson-Staples of Henderson, Henderson & Staples LC.
The case has been assigned to Circuit Judge David M. Pancake.
