BECKLEY -- A local medical practice is being sued after prematurely terminating a medical billing services agreement.
MedMatrix Solutions LLC filed a lawsuit Dec. 23 in Raleigh Circuit Court against Brian S. Love MD Inc., doing business as Love Family Practice Group, citing breach of contract.
The complaint states, the plaintiff and defendant entered into a 12-month medical billing services agreement with an effective date of Feb. 6, 2013. The contract allows early termination only if the plaintiff failed to provide adequate services, according to the complaint. The plaintiff contends they provided services according to the contract, however on July 1, 2013, the defendant unilaterally terminated the contract with an effective date of Aug. 1, 2013. The termination was six months earlier than permitted by the contract and as a result the defendant breached the contract terms, according to the complaint.
MedMatrix Solutions is seeking an undisclosed amount in damages. The plaintiff is being represented by attorney James C. Stebbins and Valerie H. Raupp of Lewis Glasser Casey and Rollins PLLC.
