Shopper injury at Harbor Freight results in lawsuit

CHARLESTON -- A Nitro resident is suing after falling and sustaining injuries while in a store.


Tina Bare filed a lawsuit Jan. 31 in Kanawha Circuit Court against Harbor Freight Tools USA Inc. and Tyler Plaza Inc.

The complaint states on Feb. 2. 2012, Bare was at the defendant's store at 915 Cross Lanes Drive in Cross Lanes. The plaintiff was using a knee walker while in the store when one of the wheels of the knee walker became caught in a depression in the floor, which caused Bare's knee walker to overturn and the plaintiff fell to the floor, according to the complaint.

The plaintiff is seeking an undisclosed amount in damages.

Bare is being represented by Steven B. Wiley of Wiley Law Offices PLLC. The case has been assigned to Circuit Judge Jennifer F. Bailey.
