CHARLESTON -- A former Wal-Mart employee is suing after he was allegedly wrongfully terminated.
Stephen Lovejoy filed a lawsuit March 17 in Kanawha Circuit Court against Wal-Mart Associates Inc. and Ryan Duncan.
The complaint states on Feb. 7, 2012, Lovejoy was employed by Wal-Mart and was working in the course of his employment when he was injured. The plaintiff says he requested a worker's compensation application from Duncan, a manager, but one never was provided.
On March 25, 2012, the plaintiff informed Duncan he needed time off for a surgery related to his work injury when Duncan became hostile and terminated Lovejoy, according to the complaint.
The plaintiff is seeking an undisclosed amount in damages.
Lovejoy is being represented by Edward D. Atkins of John R. Mitchell LC. The case has been assigned to Circuit Judge Jennifer F. Bailey.
