CHARLESTON – A woman alleges Kroger filled her prescription with seven tablets of the wrong medication.
Donna Gay filed a lawsuit Aug. 28 in Kanawha Circuit Court against Kroger Pharmacy.
In her complaint, Gay alleges she discovered on Sept. 24, 2012, that her prescription of lorazepam included seven tablets of prednisone.
"[The] defendant had negligently and carelessly filled plaintiff's prescription with the wrong medication," the suit states.
Due to Kroger's actions, Gay suffered physical injury, incurred medical costs, endured mental anguish and experienced pain and suffering, the complaint says.
In her complaint, Gay seeks compensatory damages, plus costs, pre- and post-judgment interest and attorney fees.
G. Patrick Jacobs of the Law Office of G. Patrick Jacobs in Charleston will represent her.
Circuit Judge James Stucky has been assigned to the case.
