Woman files suit to take deposition early in likely throat cancer case

FAYETTEVILLE – A Fayette County woman is filing to take a deposition for testimony over claims her cancer was misdiagnosed by her doctor.

Kathryn L. Dean filed a petition to perpetuate testimony for use in an anticipated lawsuit Sept. 22 in Fayette Circuit Court.

According to the complaint, Dean suffers from throat cancer, which doctors say is eroding her epiglottis, and she is losing her ability to speak. Since Dean could succumb to her illness before the filing of a complaint, she hopes to take deposition immediately for testimony in an anticipated suit against Plateau Surgical Associates and Dr. Serafino S. Maducdoc regarding Maducdoc's misdiagnosis of her condition and the effects of the misdiagnosis, including her throat cancer.

Dean is represented by attorneys Kyle G. Lusk and Matthew A. Bradford of Kyle G. Lusk and Associates in Beckley.
