CHARLESTON – A man alleges a bank placed numerous calls to his residence in an attempt to collect a debt, causing him inconvenience.
Hubert Rabel filed a lawsuit Aug. 12 in Kanawha Circuit Court against Huntington National Bank.
In his complaint, Rabel alleges he continuously received phone calls from the bank for an alleged indebtedness.
Rabel says the bank violated the West Virginia Consumer Credit and Protection Act by engaging in oppressive conduct by placing the phone calls to him and by causing the phone to ring at unusual times.
He also accuses the bank of common law negligence, saying it failed to train or supervise its employees, and of intentional infliction of emotional distress.
Rabel seeks actual, statuary, punitive and general damages, plus costs and other relief the court deems just. He also seeks an order that his debts be canceled.
