BECKLEY – A Raleigh County shopping center owner is suing over claims a store in the center has defaulted on lease payments.
SSC Beckley WV, filed a lawsuit Oct. 23 in Raleigh Circuit Court against Bekki Collins, doing business as Paradise Pets, citing breach of lease.
According to the complaint, on Oct. 4, 2012, Collins signed a lease to do business as Paradise Pets in a 3,885-square-foot suite in Beckley Shopping Center, owned by the plaintiffs, on North Valley Drive in Beckley. The complaint states Collins failed to honor the terms of the lease, so the parties entered into a lease relocation and modification agreement July 1, wherein Paradise Pets would relocate to a 1,360-square-foot suite in the shopping center.
SSC Beckley WV says Collins is in default under the terms of the original lease and the modified one, owing the plaintiff more than $10,800. The complaint states Collins continues to accrue other charges under the modified lease, including rent, area maintenance and insurance charges and real estate taxes.
SSC Beckley WV seeks damages, including the amount owed and the amounts accruing, interest, attorney fees and costs.
It is represented by attorney David M. Kersey of Brewster, Morhous, Cameron, Caruth, Moore, Kersey & Stafford in Bluefield. The case has been assigned to Circuit Judge John A. Hutchison.
