Putnam woman slips on yogurt at Kroger

WINFIELD – A Putnam County woman seeks damages from Kroger after she claims she slipped on yogurt and injured herself.

Antoinette Brown filed her lawsuit Dec. 11 in Putnam Circuit Court against The Kroger Co. She says the spilled yogurt on the floor of the Kroger in Teays Valley on Jan. 9, 2013, caused her to do a "full split" that "was extremely challenging" because of her age. She writes that she is a senior citizen.

"I was embarrassed, very upset, grandchildren I had to prepare for," Brown wrote in the complaint she filed herself. "People were looking at me. Just wanted to go home.

"I was asked did I want to fill an incident report. I said no. The store manager at the time said, 'Just sign your name ... meaning he would fill it in.'"

While Brown says suing any person or business is "not who I am," she said, adding that based on her beliefs and religious beliefs "suing didn't feel right.

"Integrity, strong principles (and) decency would not allow me to move forward. My statute of limitation expires Jan. 9. I have been pushed into filing a personal injury civil lawsuit. I believe compensation is in order."

Brown seeks compensatory damages for medical expenses, emotional distress, loss of consortium and future costs. She also seeks compensation for negligence and missing work time to recover, treatment and the inability to continue work.

The case has been assigned to Circuit Judge Joseph Reeder.
