PERSONNEL FILE: Martin & Seibert attorney speaks at NBI seminar

MARTINSBURG – Martin & Seibert Director of Litigation Management and General Counsel, Susan R. Snowden, recently spoke at a National Business Institute (NBI) Seminar on Construction Defect Disputes & Litigation: Using Coverage, Case Law and Indemnification to Shift Liability.

NBI provides continuing legal education for legal professionals across the country. The seminar, held in Charleston, addressed topics designed to assist lawyers in developing strategies for defending construction defect claims and the often litigated legal issue of whether an alleged detect in construction is an insured loss.

Snowden provided insight on defining "Occurrence," "Property Damage," "Accident" and "Faulty Workmanship" citing recent case law across the country and in West Virginia. Mrs. Snowden also elaborated on recent changes in West Virginia law, including the application of negligence per se for violations of building codes, recoverable damages in property losses, as recently expanded by West Virginia courts, indemnity provisions found in contracts between general and subcontractors and the shifting of liability and exposure for loss.

Snowden frequently litigates construction and construction related coverage cases in both federal and state courts.
