HUNTINGTON – A Cabell County woman is suing the Huntington Housing Authority after she slipped and fell on water that had overflowed out of a commode.
In a suit filed Feb. 8, Wilma J. Akers claims the HHA negligently breached its authority as landlord of the Riverview East Apartments in Huntington by failing to fix her commode.
Akers was a resident of the apartments when the incident occurred in May 2005. She had complained to the HHA regarding her faulty commode on several occasions prior to that time, according to the suit.
On May 23, 2005, she was in her bathroom when the commode began to overflow. She turned to get the plunger so she could attempt to keep the water from leaking onto the floor. When she turned around with the plunger, she fell in the water that had leaked out of the commode.
As a result of the fall, Akers claims she has suffered severe injuries that will require addition medical services and treatment.
The suit claims the HHA had a duty as landlord to maintain the apartment in good and safe working order but failed to do so.
Akers is seeking $35,000 in damages.
