HUNTINGTON - Two companies who completed construction work at a Huntington pharmacy are saying they weren't paid in full.
James J. Weiler and Sons, Inc., and Dixon Electrical Systems and Contracting, Inc., filed the lawsuit April 11 in Cabell Circuit Court.
They claim Terry Tiffany, doing business as Phoenix Development, still owes approximately half on a nearly $50,000 contract.
R.R. Fredeking of Huntington law firm Fredeking and Fredeking Law Offices is representing the plaintiffs.
"The Defendant had a duty to fulfill its contract with the Plaintiffs and to pay the Plaintiffs the amounts owed to them for work performed and supplies provided in the construction of the Budget Discount Pharmacy," the complaint says.
The complaint adds that Tiffany, of Huntington, agreed to pay James J. Weiler and Sons $3,022.06 for the fabrication of handrails and $203.52 for adding a stand to a safe.
Dixon Electrical Systems and Contracting was hired, it says, to perform electrical work and provide supplies in the amount $46,200, of which only half has been paid.
The plaintiffs are seeking compensatory damages. Judge John L. Cummings has been assigned the case.
