Another woman sues Whittaker for not paying settlement

CHARLESTON - A Cabell County woman has filed a suit against Jack Whittaker, claiming the Powerball winner breached a contract in connection with a confidential agreement, and she seeks the money he has failed to pay.

Rhonda Lilly filed a case Feb. 16 against Whittaker, the second of such cases to be filed in two months.

On March 23, 2004, Lilly filed a suit against Whittaker for assault and battery, claiming she was physically attacked by Whittaker at Tri-State Racetrack and Gaming Center. On May 26, 2006, Whittaker entered into a confidential settlement with Lilly. However, Lilly claims he has not paid.

Therefore, Whittaker has breached his contract with Lilly. She seeks the amount due under the settlement agreement, plus punitive and compensatory damages.

The case is similar to one filed on Jan. 10 by Kitti French. French also seeks compensation from the confidential agreement. She also claims she was assaulted by Whittaker at the racetrack.

On one occasion, Whittaker responded "On 9-11 a team of crooks went to 12 different City Nat. Banks cashed 12-Cks and got all my money I intend to pay but can't without any money. /s Jack Whittaker," the suit says.

Whittaker and City National currently have suits filed against the other, both claim neither is responsible for the money, more than $49,000 being cleared out of an account. The cases have been combined are to be heard by Judge Louis Bloom on Sept. 17 in Kanawha Circuit Court.
