Shelly Cummings v. D's Tasty Freeze, Susan Dodd, Dennis Dodd

* Shelly Cummings filed a suit against D's Tasty Freeze and its owners, Susan and Dennis Dodd. According to the suit, Cummings, employed at the Tasty Freeze, was subjected to unwanted sexual innuendo and touching by Dennis Dodd. Cummings claims she resigned and was then assaulted by the Dodds in the parking lot of the restaurant. Cummings claims she suffered emotional and mental distress, humiliation, anxiety, embarrassment, aggravation, annoyance and inconvenience. She also claims she suffered from a hostile work environment. In the six-count suit, Cummings seeks compensatory and punitive damages as well as a court injunction ordering the Tasty Freeze to establish an on-going training program for its employees.

Gene Fry v. Richard Risk and Elberta K. Risk, Risk Supermarket

* Gene Fry filed a suit against Richard and Elberta Risk, his landlords, after he was injured while taking a broken refrigerator down a flight of stairs in his apartment building. According to the suit, Fry had a broken refrigerator and was told it could not be replaced until the old unit was removed. To remove the refrigerator, Fry had to move it down a flight of stairs. According to the suit, the refrigerator fell down the stairs, hitting Fry and causing severe injuries. Fry seeks compensatory and punitive damages.

Kevin Hamrick, as Executor of the Estate of Ella Hamrick v. Select Specialty Hospital, Asif Rahman, M.D., William Sale, III, MD, Emad Kowatli, M.D., West Virginia Board of Governors

* Kevin Hamrick filed a suit on behalf of the estate of Ella Hamrick, a woman who allegedly died from negligent care at Select Specialty Hospital in Charleston. According to the suit, on July 9, 2006, Hamrick developed an infection from a right femoral IV delivering Dopamine. According to the suit, the infiltration went unnoticed until July 10-11. Hamrick developed sepsis, a decubitis ulceration and necrosis of the area of the infiltrate, the suit says. On Sept. 7, 2006, Hamrick died. Kevin Hamrick claims the defendants are responsible for Ella Hamrick's injuries and subsequent death. He seeks compensatory and punitive damages for her estate.

Thomas G. Freeman II, personal representative of the Estate of Lillian Rich v. HR of Charleston, Inc., Glenmark Associates, Inc.

* Thomas G. Freeman filed a suit on behalf of the estate of his late mother-in-law, Lillian Rich. According to the suit, Rich was a resident of Oak Ridge Center, a licensed nursing home in Charleston. Rich was admitted to Oak Ridge on Feb. 26, 2007, and remained there until Jan. 19, 2008. During her time there, Rich was a victim of negligence and abuse, the suit says. Freeman claims Rich was caused serious injuries, resulting in pain, suffering and serious injuries, and ultimately led to her death on Jan. 22, 2008. Rich, though the representative of her estate, and on behalf of her survivors, seeks compensatory and punitive damages.
