Charleston law firm hit with another malpractice suit

LOGAN – Another lawsuit has been filed against former attorney R. Michael Martin and R. Michael Martin & Associates for legal malpractice.

Melody Maynard retained Martin and his firm and entered into a contract and an attorney-client relationship, according to a complaint filed in Logan Circuit Court.

Maynard claims the defendants were retained to represent her in a negligence case and the defendants signed a binding agreement with the defendants in her 2012 lawsuit to settle that lawsuit and failed to communicate any offers of the settlement to her.

Martin and his firm neglected a reasonable duty to communicate with Maynard in her case and their failure to communicate was the proximate cause of the inability of her to move forward with her lawsuits, according to the suit.

Maynard claims she suffered a monetary loss, resulting from the defendant's failure to communicate for which the defendants were retained to pursue her lawsuit.

The defendants breached their contract with Maynard, according to the suit.

Maynard is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Steven S. Wolfe of Wolfe Law Office PLLC.

Martin and his firm have been named in at least 10 lawsuits in Wayne, Kanawha and Raleigh Circuit Court since January for legal malpractice.

In January, Martin consented to voluntary disbarment.
