CHARLESTON -- A Pocahontas County woman is suing Low-Moor Inc. after she claims her employment was wrongfully terminated because she complained about being harassed.
Martha Ann Barnett, the director at the Greenbrier Birthing Center, was also named as a defendant in the suit.
Cynthia Marie Kelly was employed as a program plan manager through Low-Moor, Inc., at the Greenbrier Birthing Center until her discharge in November 2009, according to a complaint filed Nov. 8 in Kanawha Circuit Court.
Kelly claims she was discharged under false pretenses after she complained about being harassed by Barnett.
The defendants' conduct was "wrongful, retaliatory, intentional, willful and wanton and intended to cause severe harm to Plaintiff," the complaint states.
Kelly claims the defendants terminated her employment because she had reported harassment in the workplace, which is in violation of the public policy of West Virginia.
Kelly is seeking compensatory and punitive damages and to be returned to her previous employment. She is being represented by Paul M. Stroebel.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
