New Mexico woman names 48 companies in asbestos case

CHARLESTON -- A New Mexico woman is suing 48 companies after she claims they are responsible for her husband's lung cancer and death.

David L. Grove was diagnosed with lung cancer on Oct. 9, 2009, and died March 11, 2010, according to a complaint filed March 2 in Kanawha Circuit Court.

Nancy Stewart claims her husband was employed by Armco Steel in Ashland, Ky., from 1964 until 1990.

The defendants are being sued upon theories of negligence, contaminated buildings, breach of express/implied warranty, strict liability, intentional tort, conspiracy, misrepresentations and post-sale duty to warn, according to the suit.

Stewart is seeking a jury trial to resolve all issued involved. She is being represented by John Sutter.

The case has been assigned to a visiting judge.
