CHARLESTON -- A Monroe County woman is suing West Virginia Paving after she claims it is responsible for her daughter's injuries.
On May 26, 2009, V.P.H. was severely injured in a highway construction area when a vehicle in which she was a passenger veered off to the right side of a resurfaced but unmarked two-lane federal highway and went into a ditch at the shoulder of the roadway and was then channeled into a collision with a private driveway culvert, according to a complaint filed May 25 in Kanawha Circuit Court.
P.J.D., V.P.H.'s mother, claims her daughter sustained injuries that were so severe, she became a disabled adult with braid and body injuries.
West Virginia Paving, Inc., negligently left the roadway surface center lines and edge lines unmarked and dangerous to roadway users, according to the suit.
P.J.D. claims the defendant also failed to train, direct and control its employees to fulfill its duties to make safe the passage of the vehicle in which V.P.H. was a passenger.
The defendant's negligence caused V.P.H.'s injuries and damages, according to the suit.
The plaintiff is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Larry L. Rowe.
The case has been assigned to Circuit Judge Tod J. Kaufman.
