Company says Pam Transport driver failed to secure tractor

CHARLESTON – R.A. Walker Trucking, LLC, is suing Pam Transport, Inc., and one of its drivers after it claims they caused an R.A. Walker vehicle to be damaged.

On Sept. 28, 2011, Howard LeRoy Lawrence, who was employed by Pam, failed to secure the parking brake and/or chock the wheels of a tractor he was operating, according to a complaint filed Feb. 27 in Kanawha Circuit Court.

R.A. Walker claims Lawrence’s failure to secure the vehicle caused the vehicle to roll backward and into a 2006 Freightliner owned by R.A. Walker.

Lawrence was negligent and, as a result of his negligence, caused R.A. Walker to suffer damages, including expenses and lost income directly attributable to the truck being out of service, according to the suit.

R.A. Walker claims the total damages suffered by R.A. Walker are in the amount of $14,167.66.

Pam Transport is liable for the damages because Lawrence was acting in the scope of his employment with Pam, according to the suit.

R.A. Walker is seeking damages in the amount of $14,167.66 with interest. It is being represented by Stephen P. Hoyer of Hoyer, Hoyer & Smith, PLLC.

The case has been assigned to Circuit Judge Carrie Webster.
