WINFIELD - A couple are suing Fourever Young LP for injuries sustained from slipping on an overspill of water.
On May 31, 2011, Frances Marcum was on the defendant's premises when she slipped and fell on overspill from a toilet in one of the defendant's public restrooms, according to a complaint filed May 30 in Putnam Circuit Court.
Marcum claims the excessive water on the floor rendered the floor dangerous for her and others visiting the Saville Building and the defendant knew or should have known of the excessive water on the floor of the restroom.
The defendant was negligent and careless and caused Marcum to incur medical expenses and endure physical pain and suffering and mental anguish, according to the suit.
Marcum and her husband, Harry Marcum, are seeking compensatory damages with pre- and post-judgment interest. They are being represented by David A. Ford.
