Woman files medical malpractice suit against plastic surgeon

HUNTINGTON - A woman is suing a plastic surgeon she claims she was injured during surgery.

On May 30, 2013, Dr. Michael R. Spindel performed breast augmentation surgery on Tabitha Nicole Ross, according to a complaint filed in Cabell Circuit Court.

Ross claims Spindel negligently, carelessly and recklessly failed to exercise reasonable care in her treatment.

Spindel failed to properly inform Ross of the risk, downplayed the negligent care and failed to properly treat the complications and lack of healing of Ross' wounds, according to the suit.

Ross claims the surgery was done in a negligent, careless and reckless manner and had caused multiple complications which were brought to his attention and required follow-up care.

The follow-up care provided by Spindel after the surgery was negligent, careless and reckless and included the failure to promptly recognize, diagnose and treat the complications of his negligent care, including the lack of surgical wound healing, deformities, nodules and lumps, according to the suit.

Ross claims Spindel deviated from the appropriate standard of care and acted willfully, wantonly and recklessly in Ross' treatment.

Because her injuries are permanent and will require future treatment, Ross will continue to suffer pain and discomfort, physical deformities, scarring and disfigurement, emotional distress and inability to enjoy life, according to the suit.

Ross is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by James R. Fox of Fox Law Offices PLLC.

The case is assigned to Circuit Judge F. Jane Hustead.
