Kroger customer litigates over unspecified hazardous conditions

NEW CUMBERLAND—A Pennsylvania resident filed suit against a national grocery chain, claiming personal injury when he patronized its Hancock County location in 2014.

Matthew A. Harkins of Latrobe, Pa., filed a lawsuit against The Kroger Co., headquartered in Cinncinnati and doing business in Charleston, in Hancock Circuit Court on May 21, asserting premises negligence in February 2014.

The suit states that Harkins was a customer of the business located at 3558 Main St. in Weirton on or about Feb. 25, 2014, when the plaintiff allegedly fell due to “hazardous conditions” on the defendant’s premises.

The complaint states that Kroger was negligent in failing to inspect the premises, including the sidewalk and parking lot; that it failed to maintain the property safely; and neglected to correct the dangerous condition or warn the plaintiff and other patrons of the hazard.

Harkins claims severe and disabling injuries, pain and suffering, mental anguish, aggravation, inconvenience, loss of enjoyment of life and the ability to function, and medical expenses.

He seeks damages, pre- and post-judgment interest, attorneys’ fees, and costs.

The plaintiff is represented by M. Eric Frankovitch of Frankovitch, Anetakis, Colantonio & Simon in Weirton. The case has been assigned to Judge Ronald E. Wilson.
