CHARLESTON – A former Kanawha County resident is seeking damages and reimbursement for an alleged facial operation gone awry.
Oliver Bryce Gipson, former resident of Kanawha County and currently living in California, filed suit in Kanawha Circuit Court against New Century Emergency Physicians of West Virginia Inc., which provides health care staffing for the Charleston Area Medical Center's General Division.
According to the complaint, on April 14, 2013, Gipson arrived at the CAMC emergency room after being assaulted and receiving facial lacerations earlier that evening. He was attended to by employees hired via New Century Emergency Physicians of West Virginia and not CAMC.
These physicians allegedly deviated from the acceptable levels of care when they reportedly failed to provide a plastic surgery consultation to assure best results for his facial injuries and instead used staples to repair the wound, the complaint states. Because of this, the plaintiff allegedly suffered unnecessary facial scarring, continuing embarrassment, permanent degradation of his physical appearance, psychological injury, and lost capacity to earn wages for the foreseeable future.
The plaintiff seeks general compensatory and special damages in an reasonable amount to be determined by the jury, reimbursement of all medical costs and attorney fees and court costs and any other costs deemed appropriate by the jury.
