HUNTINGTON – A Cabell County man is suing a metals industry company over injuries he sustained in a work-site accident.
Charles Adams filed a lawsuit Aug. 5 in Cabell Circuit Court against Robert C. Jones Alloys, alleging unsafe working conditions in violation of West Virginia and federal laws.
On June 8, the suit states, while Adams was working within the scope of his employment with the defendant at its business in Cabell County, he was required to operate a shearing machine that had not been properly working for months and had injured another employee earlier on said date.
The defendant did not have the machinery repaired or looked at after it had failed and injured another employee, and required Adams to work on it anyway, the suit states.
Adams' hand was subsequently caught in the machine and sustained serious injuries.
Then, while Adams was off work due to this injury and receiving workers compensation, the defendant terminated his employment on June 12, according to the suit.
Adams seeks compensatory and punitive damages, interests, and attorney fees and costs.
Adams is being represented by attorney Amy C. Crossan of Bouchillon Crossan & Colburn of Huntington. The case has been assigned to Circuit Judge Christopher D. Chiles.
