Couple alleges negligence following auction house accident

WHEELING – A Marshall County husband and wife are suing an Ohio County auction services company and its owners over injuries allegedly sustained at an auction house.

Nika J. Cochran and Carl A. Cochran filed a lawsuit Jan. 7 in Ohio Circuit Court against James Frio, Karen Frio and Frio Auctions, alleging negligence.

According to the suit, the defendants conduct business at The Highlands auction house at 574 Cabela Drive in Triadelphia.

On Jan. 11, 2014, the suit states, Nika Cochran attended an auction at The Highlands auction house, where she allegedly slipped and fell on a wet floor. The suit alleges the defendants were negligent in failing to maintain safe premises.

As a result, Nika Cochran claims she sustained bodily injuries, pain and suffering, mental anguish, loss of enjoyment of life and has incurred medical expenses. The suit claims Carl Cochran has suffered a loss of spousal consortium.

The plaintiffs seek compensatory damages, interests and other costs.

They are represented by attorney Adam E. Barney of Berry Kessler Crutchfield Taylor & Gordon in Moundsville. The case has been assigned to Circuit Judge David J. Sims.
