State accuses company of negligence in fuel spill

CHARLESTON – The West Virginia Department of Transportation is suing a private company to recover costs the state allegedly paid to clean up a fuel spill.

The West Virginia Department of Transportation, Division of Highways, and its commissioner, Paul A. Mattox Jr., filed a lawsuit March 9 in Kanawha Circuit Court against Fastrak Inc., alleging negligence.

According to the complaint, a truck owned by Fastrak accidentally struck a box culvert on March 18, 2014, puncturing its fuel take and leaving a 2- to 3-mile-long diesel fuel spill on North Fork Road (Route CR-15) in Wetzel County. The plaintiffs claim the cleanup cost $9,000.

The plaintiffs seek recovery of the cleanup costs, plus interest and litigation costs. They are represented by attorneys Chad M. Cardinal and C. Brian Matko of the West Virginia Department of Transportation. Judge Charles E. King is assigned to the case.
