Sons accuse mother’s nursing facility of wrongful death

CHARLESTON – Two Raleigh County brothers say the allegedly negligent care provided by their mother’s nursing home contributed to her death.

Timothy Tilley and Kevin Tilley, as personal representatives of the estate of Clara Jean Tilley (deceased), filed a lawsuit March 31 in Kanawha Circuit Court against Sunbridge Beckley Health Care LLC, doing business as Pine Lodge, and Genesis Healthcare LLC, alleging negligence, reckless misconduct and wrongful death.

According to the complaint, while Clara Tilley lived at Pine Lodge between Aug. 26, 2013 and Feb. 9, 2014, she endured abuse and neglect, suffering multiple falls, injuries and skin breakdown. The suit claims these injuries caused pain and suffering, mental anguish and physical impairment, aggravation of existing conditions, and medical expenses. These systematic abuses, the brothers claim, led to their mother’s death on Feb. 15, 2014.


The plaintiffs seek a jury trial and damages in an amount to be proven at trial, plus litigation costs. They are represented by attorneys Andrew L. Paternostro and Jeff D. Stewart of The Bell Law Firm PLLC in Charleston.

Judge Carrie L. Webster is assigned to the case.
