Pa. woman blames Halliburton Energy Services for car accident

MORGANTOWN – A Washington, Pa., woman is suing Halliburton Energy Services Inc. after she claims she was injured as a result of a car accident.

Joie Flickinger; E&S Contracting Inc.; and John Doe Company were also named as defendants in the suit.

On April 30, 2014, Brooke Alberta was the restrained operator of a 2007 Toyota SUV traveling south in Interstate 79 in Morgantown, according to a complaint filed in Monongalia Circuit Court.

Alberta claims at the same time, Flickinger was operating a tractor trailer owned by Halliburton and E&S and was traveling north on Interstate 79 when one of the tires broke off the tractor trailer and crossed the median.

The tire traveled into the southbound lane and struck the vehicle driven by Alberta, according to the suit.

Alberta claims Flickinger negligently, carelessly and/or recklessly failed to inspect and/or repair the tractor trailer and/or drove it in a dangerous and defective condition.

As a direct and proximate result of the negligent, careless and/or reckless conduct of Flickinger, Alberta sustained severe and disabling personal injuries and was forced to seek medical treatment and incur medical expenses, according to the suit.

Alberta claims the defendants’ actions also caused her to sustain pain and suffering; aggravation; inconvenience; loss of enjoyment of life; loss of ability to function; and other expenses. She is seeking compensatory damages with pre- and post-judgment interest. 

Alberta is being represented by Michael G. Simon and Kevin M. Pearl of Frankovitch, Anstakis, Colantonio & Simon. The case has been assigned to Circuit Judge Phillip Gaujot.
