Financing company says towing firm unlawfully held vehicle

LOGAN — A financing company is suing Bobby Hicks, doing business as Fast Action Towing and Recovery, citing alleged unlawful detention of collateral.

MidFlorida Credit Union filed a complaint on June 3 in Logan Circuit Court, alleging that the towing company refused to release a vehicle.

According to the complaint, the plaintiff alleges that it was not able to take possession or receive its collateral, a 2010 Ford F-150. The plaintiff holds the defendant responsible because the towing firm allegedly claimed a bill of $3,623.67 due for towing and storage of the subject vehicle, unlawfully held and detained the plaintiff's collateral and refused to relinquish the vehicle until the bill was paid in full.

The plaintiff requests a trial by jury and seeks a pre-judgment hearing, an order for the defendant to immediately release the vehicle into the plaintiff's possession and stop the accrual of additional storage fees, attorney's fees and costs and other such reasonable and just relief as the court deems appropriate. It is represented by Jeffrey M. Strange of Booth & McCarthy in Bridgeport.
