Homeowner sues town, officials over flooding

CHARLESTON — A homeowner is suing the Town of Chesapeake, Town of Chesapeake Sanitary Board, Damrov Bradshaw, Janet Armentrout and Rocky Hale, municipal officials, citing alleged breach of duty, negligence and insufficient measures taken to prevent damages.

Evelyn Baskin filed a complaint on May 12 in Kanawha Circuit Court against the defendants, alleging that they failed to alleviate flooding issues facing Chesapeake.

According to the complaint, the plaintiff alleges that, on or about June 13, 2014, a deleterious flood occurred in and around her home on Venable Avenue in Chesapeake, causing her to suffer damages to her personal and real property and expenditures to restore her home. Again, on or about August 11 and August 12, 2015, raw sewage allegedly entered her property, causing damage to her property, home and personal belongings. The plaintiff holds the defendants responsible because they allegedly failed to keep their sewage lines in proper repair and failed to promptly and properly remedy the problems with the sewer lines, failed to take action(s) as promised on the flooding issue and failed to follow through on promises made.

The plaintiff requests a trial by jury and seeks judgment against the defendants for compensatory damages, punitive damages, equitable relief, attorney's fees and costs, pre- and post- judgment interest and for for any and all such other and further relief as the court may deem to be proper and just.
