Woman blames Elks Club for fall

CHARLESTON — A woman is suing Elks Club, a voluntary association the provides catering and event facilities, alleging negligence and insufficient measures taken to prevent injuries.

Shelva J. Jarrett filed a complaint on June 15 in Kanawha Circuit Court against the defendant, alleging that the voluntary association violated its legal duty to protect her.

According to the complaint, the plaintiff alleges that on Aug. 2, 2014, she talking to some friends and moving to proximity of the stage at the Elks Club hall when her foot got caught between the stage and the floor, causing her to fall and suffer injuries tor her arm, a pelvis ring fracture and other wounds. The plaintiff holds the Elks Club responsible because the defendant allegedly failed to act in a reasonably prudent manner by maintaining its facility to be safe and sound.

The plaintiff requests a trial by jury and seeks compensatory damages, punitive damages, attorney fees and costs and any additional relief that the court finds appropriate. She is represented by Brian R. Blickenstaff of Turner & Johns PLLC in Charleston.
