Two lawsuits filed against CAMC for age discrimination, wrongful termination

CHARLESTON – Two lawsuits have been filed against Charleston Area Medical Center after the plaintiffs claim the hospital discriminated against them based on their ages and then wrongfully terminated their employments.

Tracy Graham and Lisa Allen were employed with CAMC, Graham from March 23, 2009, until June 2, 2015, and Allen from Sept. 3, 1991, until April 25, according to two complaints filed July 19 in Kanawha Circuit Court.

The plaintiffs claim during their employments, they and other co-workers were subjected to age discrimination, workers’ compensation discrimination and retaliation based upon complains regarding violations of nursing and hospital standards and regulations.

The defendant allowed harassment of employees based in whole or in part on their age and did not follow its discipline policy, according to the suits.

The plaintiffs claim upon their discharges, they were replaced with younger employees.

CAMC consistently failed to follow its own personnel and disciplinary policies contained in the CAMC “Employee Handbook,” according to the suits.

The plaintiffs claim CAMC violated the West Virginia Human Rights Act and other West Virginia common law.

The plaintiffs are seeking compensatory and punitive damages. They are being represented by John Einreinhofer of the Law Offices of John Einreinhofer.

The cases were assigned to Circuit Judges Carrie Webster and Tod J. Kaufman.
