Physician claims defamation by hospital CEO

PRINCETON — A physician is suing Bluefield Hospital Company LLC, Bluefield Clinic Company LLC and CEO Gigi Fergus, citing alleged defamation.

Phillip A. Peterson filed a complaint on Aug. 4 in Mercer Circuit Court against the defendants, alleging that Fergus maliciously reported that he was terminated because of bad acts.

According to the complaint, the plaintiff alleges that as a result of Fergus' false statements, he has suffered injury and damages. The plaintiff holds the defendants responsible due to allegations that Fergus made malicious defamatory statements about him, maliciously sent a letter to West Virginia Board of Medicine and the Virginia Department of Health Professionals stating that he had failed to maintain medical records and prescription data in an appropriate manner, and falsely reported to the police department that he was dangerous and in possession of numerous firearms.

The plaintiff requests a trial by jury and seeks judgment against the defendants for compensatory damages, costs and expenses incurred for this action, attorney's fees, pre- and post-judgment interest and such other relief as the court may determine to be appropriate. He is represented by C. Williams Davis of Richardson and Davis PLLC in Bluefield and William M. Mundy of Mundy & Associates in Huntington.
