Aluminum plate manufacturer allege scrap buyers owe $215,000

RIPLEY — An aluminum plate manufacturer is suing West Virginia scrap buyers, alleging breach of contract in failing to pay more than $215,000.

Constellium Rolled Products Ravenswood filed a lawsuit Sept. 16 in Jackson Circuit Court against Robert Rider and C&R Scrap Services of London, West Virginia, alleging failure to comply with contractual obligations.

According to the complaint, Constellium has suffered monetary damages for not collecting full payment for the steel and copper scrap it sold to C&R Scrap. The balance of $215,952.84 remains unpaid, the suit says. 

The plaintiff alleges the defendants violated the terms of agreement by refusing to pay the remaining balance on the purchase price and retained possession of the unsold scrap metals.

Constellium Rolled Products Ravenswood seek trial by jury, an order for the defendants to perform their obligations under the agreement, requiring the defendants to return the unsold scraps, plus all relief the court deems necessary. It is represented by attorneys Christopher L. Slaughter and Stacey Richards-Minigh of Steptoe & Johnson PLLC in Huntington.
