Jackson County customer accuses used car dealer of warranty breach

RIPLEY — A Jackson County woman is suing a Chapmanville used car dealer, alleging breach of contract and breach of warranty in selling her a defective vehicle.

Joni Redman filed a lawsuit Sept. 28 in Jackson Circuit Court against Thornhill Automotive Inc., doing business as Thornhill Acura, and Gateway One Lending & Finance LLC, alleging violation of the West Virginia Consumer Credit Protection Act.

According to the complaint, on June 26, 2015, Redman, a woman with an 8th grade education and little experience with finance or automotive matters, purchased a used Toyota RAV 4 from the defendant for about $30,000. She later discovered, the suit says, the vehicle was defective in many ways and she had to pay almost double the price she had been promised. 

The lawsuit states Redman suffered substantial repair expenses and loss of use of the vehicle and was unable to recover the funds she originally paid for the vehicle. The plaintiff alleges the defendants induced her to buy the defective vehicle at an excessive price and both failed and refused to repair the vehicle.

Redman seeks trial by jury, declaration the credit transaction was unconscionably induced and unenforceable, actual damages, penalties, attorney fees and court costs and all other appropriate relief. She is represented by attorneys Loree Stark and Gary Smith of Mountain State Justice in Charleston.
