CHARLESTON – A former Putnam County resident has filed a lawsuit against Lowe’s Home Centers and a lawnmower manufacturer after he injured his foot while mowing.
Richard E. and Leslie M. Shamblin filed the complaint against Lowe’s and MTD Products on Nov. 4 in Kanawha Circuit Court. In the filing, the Montgomery, Ala., residents said they lived in Putnam County in 2014 when the incident occurred.
Richard Shamblin says he was operating his MTD mower he purchased at Lowe’s “in a safe and proper manner” when the lawnmower “grazed across his left foot causing severe permanent injuries.”
The complaint doesn't specify whether the product was a push mower or a riding mower. But, he does say the mower was in "substantially the same mechanical and design condition" as when it was built and when he purchased it.
Shamblin says he suffered severe injuries that included the complete amputation of his left first and second toes as well as other physical injuries. He says he also suffered mental pain and anguish as well as medical expenses. His wife says she has suffered from loss of consortium because of the incident.
The plaintiffs seek compensatory damages for medical expenses, for Richard Shamblin’s pain and suffering; and for Leslie Shamblin’s loss of consortium.
They filed the complaint pro se. The case has been assigned to Kanawha Circuit Judge Charles King.
