Advanced Anesthesiology Services LLC and Dr. Jorge Roig were named as defendants in the suit.
On Aug. 5, 2014, Roig performed a Rhizotomy of T8, T9, T10, T11 and T12 on Jeffrey Brown and was negligent insofar as the affected nerve is deeper than “just a millimeter inferior” to Brown’s T8 through T12 ribs and, therefore, the procedure would not provide Brown pain relief, according to a complaint filed in Hancock Circuit Court.
Jeffrey Brown and Dorinda Brown claim on Aug. 25, 2014, Jeffrey Brown followed up with Roig and who days later, he performed a chemical neurolysis on T8 through T12 and performed it with 100 percent alcohol.
The risks of chemical neurolysis outweigh its benefits in patients like Jeffrey Brown and after the procedure, he was hypotensive and dizzy, according to the suit.
The Browns claim they requested a referral to Cleveland Clinic, where they traveled in October and Jeffrey Brown was diagnosed with intercostals neuralgia with deafferentiation pain syndrome.
The deafferentiation pain syndrome was caused by Roig’s negligent and Jeffrey Brown now uses narcotics to treat his pain and is now totally and permanently disabled, according to the suit.
The Browns claim that Roig owed a duty of care to Jeffrey Brown and breached that duty.
Roig was negligent and also caused Dorinda Brown to suffer a loss of consortium, according to the suit.
The Browns are seeking compensatory damages. They are being represented by Peter D. Giglione of the Massa Law Group.
