HUNTINGTON — A Huntington man is suing an apartment operator, alleging wrongful eviction.
Brandon Price filed a complaint Jan. 27 in Cabell Circuit Court against Spruce Manor Inc., alleging the defendant's agent wrongfully filed a wrongful occupation petition.
According to the complaint, on Jan. 16, 2015, Price leased an apartment from defendant in Huntington. Pursuant to the terms of HUD program, the plaintiff's portion of the monthly rent was $6 per month, the suit says.
On Nov. 21, 2016, Price says he received a notice to vacate the apartment for not paying his rent for four months in the amount of $608. The plaintiff alleges Spruce Manor's agent refused the request by Price and his counsel to review the lease file and refused to give them an opportunity to engage in informal meetings.
Price seeks trial by jury, an order enjoining the defendant from any further actions to evict the plaintiff from the apartment and directing the defendant to make available for inspection all information pertaining to the lease agreement. He is represented by attorney J. William St. Clair of Legal Aid of West Virginia in Huntington.
