Motorist alleges Allstate breached contract

BECKLEY — A Raleigh County motorist is suing Allstate Insurance, alleging breach of an insurance contract.

Tammy Thomas of Beckley filed a complaint June 15 in Raleigh Circuit Court against Allstate Insurance Company, alleging the insurer refused to effectuate a prompt, fair and equitable settlement on the plaintiff's claim.

According to the complaint, on June 16, 2015, Thomas was operating a motor vehicle insured by Allstate on Robert C. Byrd Drive in Beckley when an underinsured motorist's vehicle collided with the plaintiff's car. Thomas says she suffered severe and permanent injuries and incurred medical expenses and economic losses. 

The plaintiff alleges Allstate failed to adequately compensate for her injuries and damages.

Thomas seeks trial by jury, damages in an amount to be determined by jury, plus interest, attorney fees, court costs and expenses and all other just and proper relief. She is represented by attorneys Stephen P. New and Amanda J. Taylor of Stephen P. New, Attorney at Law in Beckley.
