Shopper alleges he was injured at Quincy Walmart

CHARLESTON – A Kanawha County man alleges he was injured while shopping at a Walmart because he tripped on a stocking cart.

Harry A. Mullins filed a complaint on July 14 in the Kanawha Circuit Court against Wal-Mart Stores East LP and Wal-Mart Stores Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on May 16, he was shopping at the Quincy Walmart and sustained physical injuries from tripping over an unattended stocking cart. 

The plaintiff holds Wal-Mart Stores East LP and Wal-Mart Stores, Inc. responsible because the defendants allegedly failed to warn the plaintiff of the dangerous condition and failing to correct or remove it.

The plaintiff requests a trial by jury and seeks judgment against the defendants to fairly compensate him for his injuries and damages, interest, court costs and any further relief the court grants. He is represented by Robert B. Warner and Christopher Schumacher of Warner Law Offices PLLC in Charleston. The case has been assigned to Circuit Judge James C. Stucky.
