Chapmanville resident accuses Polaris Industries Inc. of breach of warranty

LOGAN — A consumer is suing Polaris Industries Inc., a recreational vehicle manufacturer, citing alleged breach of warranty.

Terry Belcher filed a complaint Aug. 2 in Logan Circuit Court against Polaris Industries Inc. alleging that the recreational vehicle manufacturer failed to conform the vehicle with its warranties.

According to the complaint, the plaintiff alleges that, in Sept. 9, 2014, he purchased a 2014 Polaris Razor 900 for $18,124.33. Since purchase, he has experienced repeated nonconformities with the motor vehicle. Such nonconformities substantially impaired its use, value and safety. The plaintiff holds Polaris Industries Inc. responsible because the defendant allegedly failed to repair the subject vehicle in a good and workmanlike manner.

The plaintiff requests a trial by jury and seeks revocation of acceptance and refund of the purchase price and all other reasonable expenses, damages for loss of use, attorney's fees, costs and such other appropriate relief. He is represented by Steven S. wolfe of Wolfe, White & Associates in Logan.
